These Terms apply to both UGC Creators and Marketing Agencies/Brands, and any use of the Website or its services indicates your acceptance of these Terms.

1. Definitions

  • “UGC Creator” refers to users who create and upload User Generated Content for the purpose of showcasing their work to potential clients, such as brands and agencies.
  • “Marketing Agencies/Brands” refer to entities that use the Website to find and engage with UGC Creators to produce content for their marketing purposes.
  • “We”, “Our”, and “Us” refer to Silver But Savvy.

2. Eligibility

  • UGC Creators must be aged 50 or over and provide accurate information about their identity and expertise.
  • Marketing Agencies/Brands must be legitimate business entities or representatives acting on behalf of such entities.
  • By registering, you confirm that you meet these eligibility requirements.

3. Membership

3.1. UGC Creators

  • UGC Creators must pay the current annual membership fee. Founding members may receive promotional benefits, including a free trial period.
  • As a UGC Creator, you are responsible for maintaining the accuracy of your profile and portfolio.
  • Content uploaded to the platform must be original, owned by you, and must not infringe the intellectual property rights of third parties.

3.2. Marketing Agencies/Brands

  • Membership for Marketing Agencies/Brands is free. Agencies and brands can use the platform to search for and engage UGC Creators.
  • Brands and Agencies are responsible for any contracts and agreements made with UGC Creators.
  • Brands may post job opportunities on the Website’s Job Board for a small fee, outlined in the Job Board Application section, and other locations throughout the website.

4. User Responsibilities

4.1. UGC Creators

  • You retain ownership of your content but grant Silver But Savvy the right to display your content on the Website.
  • You agree not to upload any unlawful, defamatory, obscene, or harmful content.
  • You are responsible for the quality, accuracy, and legality of the content you provide and understand that any direct agreements with brands or agencies are outside the scope of Silver But Savvy’s responsibilities.

4.2. Marketing Agencies/Brands

  • You agree to use the platform for the legitimate purpose of engaging UGC Creators and not for fraudulent or illegal activities.
  • You must not exploit or manipulate UGC Creators in any way. You are encouraged to clearly outline project terms, payments, and expectations when negotiating with creators.
  • Silver But Savvy does not guarantee the performance or suitability of any UGC Creator listed on the platform.

5. Payments

5.1. For UGC Creators

  • Membership fees for UGC Creators are non-refundable unless explicitly stated otherwise.
  • All payments are processed securely via third-party payment processors, and you agree to provide accurate payment details.

5.2. For Marketing Agencies/Brands

  • Posting job advertisements on the Job Board is subject to a small fee, which will be clearly stated before posting. All fees must be paid in full before the advertisement goes live.

6. Intellectual Property

  • All content uploaded by UGC Creators remains their intellectual property. By submitting content, you grant Silver But Savvy a non-exclusive, worldwide, royalty-free license to display your content on the Website.
  • Any intellectual property belonging to Silver But Savvy, including trademarks, branding, and Website content, must not be copied, reproduced, or used without permission.

7. Content Standards

  • Content uploaded must be appropriate for a professional setting and must not infringe on the rights of others.
  • Silver But Savvy reserves the right to remove any content that violates these terms or that we deem inappropriate, offensive, or in breach of any applicable laws.

8. Termination of Membership

  • Silver But Savvy reserves the right to suspend or terminate memberships of both UGC Creators and Marketing Agencies/Brands if these Terms and Conditions are breached.
  • UGC Creators may terminate their membership at any time, but no refunds will be issued for unused membership periods.
  • Marketing Agencies/Brands may terminate their free membership at any time, with any outstanding paid Job Board postings continuing until their term expires.

9. Limitation of Liability

  • Silver But Savvy acts as an intermediary platform connecting UGC Creators with Marketing Agencies/Brands. We are not responsible for the content provided by creators or the terms of any agreements made between creators and brands.
  • Silver But Savvy is not liable for any loss, damage, or dispute arising from interactions between users.
  • We do not guarantee the availability of the Website or uninterrupted service and shall not be liable for any interruptions in service.

10. Dispute Resolution

  • Any disputes arising between UGC Creators and Marketing Agencies/Brands must be resolved directly between the parties involved.
  • Silver But Savvy is not responsible for mediating or resolving disputes between users.
  • In the event of legal disputes involving Silver But Savvy, UK law shall apply, and any proceedings will take place in UK courts.

11. Privacy and Data Protection

  • We are committed to protecting your personal data. Please refer to our Privacy Policy for more details on how we collect, use, and store your information.
  • By using the Website, you consent to the collection and use of your personal data in accordance with our Privacy Policy.

12. Changes to These Terms

  • Silver But Savvy reserves the right to modify these Terms and Conditions at any time. We will notify members of any significant changes by email or through the Website.
  • Continued use of the Website after changes to the Terms will indicate your acceptance of the updated Terms.
